M/s. SlevenTech Pvt Limited (hereinafter, “we”, “us”, “our”, “Company” or “Commendify”), respects the privacy of its User, Supporters and Organizations (“you” or “your”, “yourself” or “Users”), and has developed this Privacy Policy to demonstrate its commitment towards protecting your privacy.

We wrote this Policy to help you understand what information we collect, how we use it, and what choices you have in relation to our services, application, website and the software provided on or in connection by/with Commendify. Our Policy applies to all visitors, registered persons/entities and others who access Commendify’s website and our services. We suggest you read this Privacy Policy in conjunction with the ‘Terms and Conditions of Use’ of Commendify.

When you access or use Commendify’s website, you agree to our Privacy Policy and the Terms and Conditions of Use of Commendify (as may be applicable to you). You further confirm and agree to our collection, storage, use and disclosure of your personal information as we have set out in this Policy. IF YOU DO NOT ACCEPT AND AGREE WITH OUR PRIVACY POLICY THEN YOU MUST NOT ACCESS ANY SERVICES PROVIDED BY THE COMPANY.

By using Commendify, you understand and agree that we are providing a platform for you to post comments, reviews and other content online, including text, photos, images, bank details, credit card details and comments, making online payments ("User Content"). You also understand that after you post such content/any content, such User Content shall be available publicly. This means that other users/persons/entities may search for, see or share any of the User Content that you post online through Commendify. Commendify assumes zero liability of the User Content posted/uploaded by you and you shall keep Commendify harmless and indemnified against any claim/demand raised by any person on account of any User Content posted/uploaded by you. 

Commendify reserves the right to remove, without permission, any User Content deemed inappropriate, or is reported to be improper or inappropriate by other users/persons/entities, for example, User Content containing nudity, obscene images, etc. Any user content that violates copyrights, trademarks etc. or any intellectual property right, shall also be removed. Commendify reserves the right to ban any User, report to authorities, and take action against any User who misuses Commendify and/or posts content that may be deemed inappropriate.

Commendify reserves the right to change our Policy at any time and without notice, so be sure to check this Policy regularly to understand how we use your information.

Commendify further declares that any information collected about the User by Commendify is directly through the User or through the social networking website accounts (such as Facebook, Twitter, Google+ etc.), provided by the User at the time of registration. Commendify does not physically verify any information provided by the Users at the time of registration. In case you have any queries, concerns, complaints regarding the information or social networking website accounts, provided by any User, please feel free to write to us at support@commendify.com.  

This Policy and/or any dispute or claim arising out of and/or in connection with it or its subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the Laws of India and the Courts at New Delhi shall have exclusive jurisdiction over all disputes arising out of this Policy.

A. THE VARIOUS INFORMATIONS WE COLLECT

We collect information in a few different ways, which have been defined below: 

Information we obtain with your permission:

  1. Information from your Social Networking Website Accounts:
  2. You can sign in using your social networking website accounts. When you do so, you authorize us to access your social networking website account information (like the information provided on your Facebook Account, Google+ Account, Twitter Account etc.). Such information may include your public profile (consistent with your privacy settings on such social networking website), your email address, interests, likes, gender, birthday, education, relationship interests, current city, photos, personal description, friend list, and other information about and photos of your online friends who might be common friends with other Commendify Users.
  3. The information we get from these social networking websites or any other websites often depends on your privacy settings and/or privacy policies of such social networking websites. Therefore, you are advised to check the privacy policies of such social networking websites that you subscribe to.
  4. Location Information

You will also be asked to allow Commendify to collect your Location Information from your device/mobile when you download or use the Services. Such information may include your current location, location of your house, work place etc.

 

Information You Provide Us Directly:

  1. Information you provide us at the time of Registration, in order to register as a Supporter or Organization or User with Commendify, shall be subject to this Privacy Policy. Such information may include, but, is not restricted to:

(a) Full Name/Organization Name

(b) Date of Birth/Date of Incorporation

(c) Gender

(d) Email Address/Contact Details

(e) Password

(f) User ID

(g) Address

(h) Bank Information/Details

(i) Credit Card Details

  1. Social Networking Account Information.

*Note: Commendify reserves the right to provide the User ID at its sole discretion, and subject to availability of said User ID with Commendify.

  1. User Content (e.g., photos, comments, images, credit/debit card details, bank details and/or any other materials) that you post to online on Commendify’s wesite and/or in connection with the Services, shall be subject to this Privacy Policy.
  2. Communications between you and Commendify. For example, we may send you service-related emails (e.g., account verification, changes/updates to features of the service, technical and security notices).

*Note that you may not be able to opt out of service-related e-mails.

 

Analytics Information

  1. We may use third-party analytics tools to help us measure traffic and usage trends for the Services. These tools collect information sent by your device to our Services, including the web pages you visit, add-ons, and other information that assist us in improving the Services.
  2. We may collect and use this analytics information along with analytics information from other users, so that it cannot reasonably be used to identify any particular individual user.

 

Cookies and Similar Technologies

  1. When you visit the Services, we may use cookies and similar technologies like pixels, web beacons, and local storage to collect information about how you use Commendify and accordingly provide features to you.
  2. We may ask advertisers or other partners to serve ads or services to your devices, which may use cookies or similar technologies placed by us or a third party.

 

Log File Information

  1. Log file information is automatically reported by your browser each time you make a request to access (i.e., visit) a web page or Services. It can also be provided when the content of the webpage or Services is downloaded to your browser or device.
  2. When you use our Services, our servers automatically record certain log file information, including your web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Services, domain names, landing pages, pages viewed, and other such information.
  3. We may also collect similar information from emails sent to our users which then help us track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Services.

 

Device Identifiers

  1. When you use a mobile device like a tablet or phone to access our Services, we may access, collect, monitor, store on your device, and/or remotely store one or more "device identifiers." Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device.

Some features of the Service may not function properly if use or availability of device identifiers is impaired or disabled.

 

Metadata

  1. Metadata, generally, is technical data that is associated with User Content. For example, Metadata can describe how, when and by whom a piece of User Content was collected and how that content is formatted.
  2. User can add or may have Metadata added to their User Content including a hashtag (e.g., to mark keywords when you post a photo), geotag (e.g., to mark your location to a photo), comments or other data. This makes your User Content more relevant for other users. All photos and images posted on the Services are automatically geotagged, and your latitude and longitude will be stored with the photo and searchable (e.g., through a location or map feature) if your photo is made public by you in accordance with your privacy settings for each photo.

 

B. HOW WE USE YOUR INFORMATION

 

In addition to some of the specific uses of information we describe in this Privacy Policy, we may use information that we receive to:

  1. Help you efficiently access your information after you sign in;
  2. Remember information so you will not have to re-enter it during your visit or the next time you visit the Services;
  3. Provide personalized content and information to you and others, which could include online ads or other forms of marketing;

  15. Automatically update the Commendify Application on your device.

 

C. SHARING OF YOUR INFORMATION

 

We will not rent or sell your information to third parties outside the Company (or the group of companies of which Commendify is a part) without your consent, except as noted in this Policy.

Parties with whom we may share your information:

  1. We may share User Content and your information (including but not limited to, information from cookies, log files, device identifiers, location data, and usage data) with businesses that are legally part of the same group of companies that Commendify is part of, or that become part of that group ("Affiliates"). Affiliates may use this information to help provide, understand, and improve the Service (including by providing analytics) and Affiliates' own services (including by providing you with better and more relevant experiences). But these Affiliates will honor the choices you make about who can see your photos.
  2. We may also share your information as well as information from tools like cookies, log files, and device identifiers and location data, with third party entities that help us provide the service to you ("Service Providers"). Our Service Providers will be given access to your information as is reasonably necessary to provide the Service under reasonable confidentiality terms.
  3. We may also share certain information such as cookie data with third party advertising partners. This information would allow third party ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you.
  4. We may remove parts of data that can identify you and share anonymized data with other parties. We may also combine your information with other information in a way that it is no longer associated with you and share that aggregated information.

 

Parties with whom you may choose to share your User Content:

  1. Any information or content that you voluntarily disclose for posting to the Services, such as User Content, becomes available to the public, as controlled by any Applicable privacy settings that you set (for example, age restriction of Users to whom the content will be shared). You can change your privacy settings on the Services.
  2. Subject to your profile and privacy settings, any User Content that you make public is shown to other Users.
  3. If you remove information that you posted to the Services, copies may remain viewable in cached and archived pages of the Services, or if other Users or third parties using the Commendify API have copied or saved that information.

 

What Happens in the Event of a Change of Control

If we sell, or otherwise transfer, part or whole of Commendify, or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information such as name and email address, User Content and any other information collected through the Service may be among the items sold or transferred. You will continue to own your User Content. The buyer or transferee will have to honour the commitments we have made in this Privacy Policy.

 

Responding to Legal Requests and Preventing Harm

  1. We may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of your home country where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.
  2. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm. D. STORAGE OF YOUR INFORMATION

  1. Your information collected through the Services may be stored and processed in India or any other country in which Commendify, its affiliates or service providers maintain facilities.
  2. Commendify, its affiliates, or service providers may transfer information that it collects about you, including personal information across borders and from your country or jurisdiction to other countries or jurisdictions around the world.
  3. If you are located in the U.S., European Union or other regions where the laws governing data collection and use differ from Indian law, please note that we may transfer information, including personal information, to India, and the courts at New Delhi shall have exclusive jurisdiction. The law as applicable in India shall be applicable on the Company for governing data collection and use at all times.
  4. By registering for and using the Services you consent to the transfer of information to India or to any other country in which Commendify, its affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.
  5. We use commercially reasonable safeguards to help keep the information provided by you, and/or collected through the Service, secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, Commendify cannot ensure the security of any information you transmit to Commendify or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed.
  6. Please do your part to help us. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and Commendify at all times. Your privacy settings may also be affected by the changes the social media services, by which you connect to Commendify, make to their services.
  7. We are not responsible for the functionality, privacy, or security measures of any other organization.

 

E. YOUR CHOICES ABOUT YOUR INFORMATION

 

  1. You may update your account on Commendify at any time by logging in and changing your profile settings.
  2. You may unsubscribe from email communications from us by clicking on the "unsubscribe link" provided in such communications. As noted above, you may not opt out of service-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Services, technical and security notices).

F. DURATION OF RETENTION OF YOUR USER CONTENT

 

  1. Following termination or deactivation of your account, Commendify, its affiliates, or its service providers may retain information (including your profile information) and User Content for a commercially reasonable time for backup, archival, and/or audit purposes.

G. CHILDREN POLICY

 

Commendify does not knowingly collect or solicit any information from anyone under the age of 18 or knowingly allow such persons to register for the Services. The Services and its content are not directed at children under the age of 18. In the event that we learn that we have collected personal information from a child under the age of 18 years, we will delete that information as quickly as possible. H. YOUNG-ADULTS PRIVACY POLICY

  1. Young Adults Policy

Commendify considers persons from the age of 13-18 years as 'Young Adults'. If you a Young Adult you will be allowed to register and use the Commendify and shall be considered a User under the Policy, however, you must always have the consent of your Parents. Commendify assumes that by registering you have taken parental consent to create an account and use Commendify. IN CASE YOU DO NOT HAVE PARENTAL CONSENT THEN YOU MUST NOT CREATE AN ACCOUNT AND/OR ACCESS OR USE COMMENDIFY AND/OR ANY SERVICES PROVIDED BY THE COMPANY.

  1. Parental Guidance

We urge the Parents of Young Adults to go through with the ‘Privacy Policy’ and the ‘Terms of Use’ of Commendify, before allowing Young Adults to create an account and use Commendify. The terms of the Privacy Policy and Terms of Use shall be applicable on Young Adults.

While using Commendify, Young Adults can post content online, including comments, reviews  photos and images  (i.e. the User Content), which can be viewed publicly. We assume that Young Adult using the App has Parental Consent and the Parents shall be responsible to all acts of the Young Adult. Parents are advised to keep a tab on the images, pictures, comments posted by Young Adults on Commendify.

Commendify assumes zero liability of the User Content posted by Young Adults on the App.

Commendify reserves the right to remove without permission any User Content deemed inappropriate, or is reported by other users/persons/entities/Parents for example, User Content containing nudity, obscene images, etc. Any user content that that violates copyrights, trademarks etc. or any intellectual property right shall also be removed.

Commendify reserves the right to ban any Young Adult, report to authorities, and take action against any Young Adult/Parents in case a Young Adult misuses Commendify and/or posts content that may be deemed inappropriate.

Commendify does not solicit any information or User Content from any Young Adult. Commendify further declares that any information collected about the Young Adult by Commendify is directly through the Young Adult or through the Facebook Account provided by the Young Adult at the time of registration and such information is voluntarily provided by the Young Adult. Commendify does not physically verify any information provided by the Young Adult.

In the event that we learn that we have collected personal information from a Young Adult without Parental Consent we will delete that information as quickly as possible. If you believe that we might have any information from or about a Young Adult without Parental Consent, you may write into us at supoort@commendify.com.

                 THE RATING SYSTEM

 

You can rate User Content that you have access to with options provided on the Website.

 

The Ratings are provided by the Users/users in their own discretion. The Rating System are only mirror the general view of the Users/users for the User Content posted by you. The Rating System cannot be used to justify popularity of any particular User Content. 

 

Commendify does not solicit/influence /control the Ratings provided by the Users/users. Commendify shall not be responsible in any manner for the Ratings provided by the Users/users to the User Content posted by you and/or any other user/person or entity.

Rating User Content does not result in the sharing of any personally identifiable information with the owner of that User Content.

Commendify reserves the right to change the Rating System at anytime without liability and without giving any prior notice.

 

J. OTHER WEB SITES AND SERVICES

  1. We are not responsible for the practices employed by any websites or services linked to or from our Services (including other social networking sites), and including the information or content contained within them.
  2. Please remember that when you use a link to go from our Services to another website or service, our Privacy Policy does not apply to those third-party websites or services.
  3. Your browsing and interaction on any third-party website or service, including those that have a link on our website, are subject to that third party's own rules and policies.
  4. In addition, you agree that we are not responsible and do not have control over any third-parties that you authorize to access your User Content. If you are using a third-party website or service and you allow them to access your User Content, you do so at your own risk.
